Kullanım Koşulları

Bu koşullar, Kuzey Kıbrıs Mall platformunu (mobil uygulamalar ve internet sitesi) kullanımınızı düzenler. Hesap oluşturarak veya platformu kullanarak bu koşulları kabul etmiş sayılırsınız.

1. Platformun niteliği

Kuzey Kıbrıs Mall, bağımsız satıcıları ve müşterileri bir araya getiren bir pazaryeridir. Ürünler, platformdaki satıcılar tarafından satılır; satış sözleşmesi müşteri ile ilgili satıcı arasında kurulur. Platform, bu işlemlerde aracı hizmet sağlayıcıdır.

2. Hesap

• Hesap oluşturmak için 18 yaşında olmanız ve doğru, güncel bilgi vermeniz gerekir.
• Hesabınızın ve parolanızın güvenliğinden siz sorumlusunuz; hesabınızla yapılan işlemler sizin adınıza yapılmış sayılır.
• Hesabınızın izinsiz kullanıldığını fark ederseniz bize gecikmeden bildirmelisiniz.

3. Siparişler ve fiyatlar

• Ürün bilgileri, fiyatlar ve stok durumu satıcılar tarafından sağlanır ve değişebilir. Hatalı fiyat veya stok bilgisi halinde siparişi iptal etme hakkımız ve satıcının hakkı saklıdır.
• Sipariş, satıcı tarafından onaylandığında kesinleşir. Ödeme yöntemleri, teslimat ücretleri ve süreleri ödeme sırasında gösterilir.
• Kapıda ödeme seçeneğinde bedel teslimat sırasında ödenir.

4. İade, iptal ve cayma

İade, iptal ve geri ödeme koşulları İade Politikası, İptal Politikası, Geri Ödeme Politikası ve Mesafeli Satış Sözleşmesi'nde düzenlenmiştir ve bu koşulların ayrılmaz parçasıdır.

5. Yasaklı kullanımlar

• Yasalara aykırı, yanıltıcı, sahte veya başkalarının haklarını ihlal eden ürün ya da içerik yayınlamak.
• Platformun güvenliğini veya işleyişini bozmaya, yetkisiz erişime ya da otomatik yöntemlerle veri toplamaya çalışmak.
• Başka bir kişinin hesabını veya kimliğini kullanmak.
• Yorum ve değerlendirmelerde hakaret, tehdit veya sahte içerik paylaşmak.

6. Satıcılar için ek koşullar

• Satıcılar; sattıkları ürünlerin yasal, orijinal ve tanımına uygun olmasından, stok ve fiyat bilgilerinin doğruluğundan ve siparişleri zamanında hazırlamaktan sorumludur.
• Komisyon, ödeme ve ödeme dönemlerine ilişkin koşullar satıcıya kayıt sırasında ve satıcı panelinde bildirilir.
• Bu koşulları ihlal eden satıcıların mağazaları askıya alınabilir veya kapatılabilir.

7. Fikri mülkiyet

Platformun adı, logosu, tasarımı ve yazılımı Kuzey Kıbrıs Mall'a veya lisans verenlerine aittir; izinsiz kopyalanamaz veya çoğaltılamaz. Yüklediğiniz içeriğin sorumluluğu size aittir; platformda sergilenmesi için bize gerekli kullanım iznini vermiş olursunuz.

8. Sorumluluğun sınırlandırılması

Platformu kesintisiz ve hatasız sunmak için çaba göstermekle birlikte, mevzuatın izin verdiği ölçüde; satıcıların sunduğu ürünlerden, üçüncü taraf hizmetlerden ve platforma erişimdeki geçici kesintilerden doğan zararlardan sorumlu değiliz. Tüketicilerin yasal hakları saklıdır.

9. Hesabın askıya alınması ve kapatılması

Bu koşulları ihlal etmeniz halinde hesabınızı askıya alabilir veya kapatabiliriz. Hesabınızı dilediğiniz zaman uygulama içinden silebilirsiniz.

10. Değişiklikler ve uygulanacak hukuk

Bu koşulları gerektiğinde güncelleyebiliriz; güncel sürüm platformda yayınlanır ve gerektiğinde onayınız yeniden istenir. Bu koşullar Kuzey Kıbrıs Türk Cumhuriyeti hukukuna tabidir; uyuşmazlıklarda yetkili mahkemeler ve tüketici hakem heyetleri yetkilidir.

Terms and Conditions

These terms govern your use of the Kuzey Kıbrıs Mall platform (the mobile apps and the website). By creating an account or using the platform you accept these terms.

1. Nature of the platform

Kuzey Kıbrıs Mall is a marketplace that brings independent sellers and customers together. Products are sold by the sellers on the platform; the sales contract is formed between the customer and the relevant seller. The platform acts as an intermediary service provider.

2. Account

• You must be at least 18 and provide accurate, up-to-date information to create an account.
• You are responsible for the security of your account and password; activity under your account is treated as yours.
• Tell us without delay if you notice unauthorised use of your account.

3. Orders and prices

• Product details, prices and stock are provided by sellers and may change. We and the seller may cancel an order placed on an incorrect price or stock.
• An order is confirmed when the seller accepts it. Payment methods, delivery fees and times are shown at checkout.
• With cash on delivery, payment is made at the time of delivery.

4. Returns, cancellation and withdrawal

Return, cancellation and refund conditions are set out in the Return Policy, Cancellation Policy, Refund Policy and the Distance Selling Agreement, which form part of these terms.

5. Prohibited use

• Posting unlawful, misleading, counterfeit products or content, or content that infringes others' rights.
• Attempting to disrupt the platform's security or operation, gain unauthorised access, or collect data by automated means.
• Using another person's account or identity.
• Posting insults, threats or fake content in reviews and ratings.

6. Additional terms for sellers

• Sellers are responsible for products being lawful, genuine and as described, for accurate stock and price information, and for preparing orders on time.
• Commission, payment and payout terms are communicated to the seller at registration and in the seller panel.
• Sellers who breach these terms may have their shop suspended or closed.

7. Intellectual property

The platform's name, logo, design and software belong to Kuzey Kıbrıs Mall or its licensors and may not be copied without permission. You are responsible for content you upload and grant us the licence needed to display it on the platform.

8. Limitation of liability

While we work to provide the platform without interruption or error, to the extent permitted by law we are not liable for products offered by sellers, third-party services, or temporary interruptions of access. Consumers' statutory rights are preserved.

9. Suspension and termination

We may suspend or close your account if you breach these terms. You can delete your account at any time from within the app.

10. Changes and governing law

We may update these terms when needed; the current version is published on the platform and your consent may be requested again. These terms are governed by the law of the Turkish Republic of Northern Cyprus; the competent courts and consumer arbitration bodies have jurisdiction over disputes.
